1. Agreement to Terms

Welcome to PraiseMe! These Terms of Service ("Terms") govern your use of the PraiseMe mobile application (the "App") operated by PraiseMe ("we," "us," or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you do not have permission to use the App.

These Terms apply to all users of the App, including parents, guardians, and family members who access or use the App.

2. Eligibility

To create a parent account and use the App, you must:

• Be at least 18 years of age (or the age of majority in your jurisdiction)
• Be a parent or legal guardian of any children whose profiles you create in the App
• Have the legal authority to agree to these Terms
• Not be prohibited from using the App under applicable laws

Children's Access: The App includes a "Kids Mode" designed for children to view their rewards and progress. Children may only access the App under parental supervision and through profiles created by their parents or guardians. Children do not create their own accounts.

3. Account Registration

To use the App, you must create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or use of your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, misleading, or violates these Terms.

4. Description of Service

PraiseMe is a family reward and praise tracking application that allows parents to:

• Create profiles for their children
• Give praise points for positive behavior
• Create and assign tasks with point rewards
• Set goals and rewards for children to work toward
• Track progress and achievements
• Invite other family members to participate

Children can access "Kids Mode" to view their points, tasks, goals, and achievements in a child-friendly interface that is always ad-free.

5. Subscription and Payments

Free Tier

The App offers a free tier that includes:

• One (1) child profile
• All core features (praise points, tasks, goals)
• Kids Mode is always ad-free
• Occasional app open advertisements in Parent Mode

Premium Subscription

The Premium subscription ($1.99/month) includes:

• Unlimited child profiles
• Completely ad-free experience
• All features included
• Priority support

Billing

• Subscriptions are billed through the Apple App Store
• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your App Store account settings

Refunds

Refunds are handled by Apple according to their refund policies. To request a refund, please contact Apple Support or visit reportaproblem.apple.com.

6. User Content

"User Content" refers to any content you create or upload through the App, including child profile names, task descriptions, goal descriptions, and any other text or images.

You are solely responsible for your User Content. By creating User Content, you represent and warrant that:

• You have the right to create and share such content
• Your content does not violate any third-party rights
• Your content does not contain unlawful, harmful, or objectionable material
• Your content accurately represents information about your family

We do not claim ownership of your User Content. However, you grant us a limited license to use, store, and process your User Content solely for the purpose of providing and improving the App.

7. Acceptable Use

You agree not to use the App to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with the proper functioning of the App
• Use the App for any commercial purposes not authorized by us
• Create accounts for anyone other than yourself without permission
• Share your account credentials with others
• Reverse engineer, decompile, or disassemble any part of the App
• Use automated systems or bots to access the App

8. Intellectual Property

The App and its original content, features, and functionality are owned by PraiseMe and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. Nothing in these Terms grants you any right to use our trademarks, logos, or other brand features.

9. Third-Party Services

The App may contain links to or integrate with third-party services, including:

• Apple App Store (for subscriptions and payments)
• Google AdMob (for advertising in free tier)
• Authentication providers (Sign in with Apple, Google)

We are not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is governed by their respective terms of service.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. You acknowledge that your use of the App is at your sole risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PRAISEME, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the App
• Any conduct or content of any third party on the App
• Any content obtained from the App
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you for all claims arising from or related to these Terms or the App shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

Note for EU, UK, and Canadian users: Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.

12. Indemnification

You agree to defend, indemnify, and hold harmless PraiseMe and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

You may terminate your account at any time by deleting your account through the App settings or by contacting us at info@praiseme.cc.

Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

For users in the European Union, UK, or Canada: Nothing in these Terms affects your rights as a consumer to rely on mandatory provisions of local law. You may bring legal proceedings in your country of residence.

For users in Ukraine: Ukrainian consumers may rely on mandatory consumer protection provisions under Ukrainian law.

We encourage you to contact us first to resolve any disputes informally. If a dispute cannot be resolved informally, you agree to submit to the exclusive jurisdiction of the courts located in Delaware for resolution, subject to applicable consumer protection laws in your jurisdiction.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting the updated Terms in the App and updating the "Last updated" date.

Your continued use of the App after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the new Terms, please stop using the App.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PraiseMe regarding your use of the App and supersede all prior agreements, understandings, and communications, whether written or oral.
